1. Seller

2. Scope

These Terms apply to all orders placed on this website by consumers. Sales to retailers and other businesses are governed by separate wholesale terms. By placing an order, you accept these Terms. The version that applies is the one in force on the date of your order.

3. Products

Products are described and shown as accurately as possible. Slight differences in color may appear depending on your screen. Products are offered while stocks last. Items available for pre-order are clearly marked as such, with an estimated delivery date.

4. Orders

To place an order, add products to your cart, enter your delivery and billing details, choose a delivery and payment method, review your order and confirm payment. You will receive a confirmation email with your order number and order details. The contract is formed when this confirmation is sent.

We may refuse or cancel an order for a legitimate reason, in particular a pricing error, an unavailable product, a payment problem or suspected fraud. In that case you are informed and refunded in full within 14 days.

5. Prices and payment

Prices are shown in euros. For deliveries in France and the European Union, prices include VAT. For deliveries outside the European Union, prices are shown without French VAT; import duties, taxes and customs clearance fees charged in the country of delivery are payable by the customer and are not included.

Delivery charges are shown before you confirm your order. The price that applies is the one shown at checkout.

Payment is due in full when you order, using one of the payment methods shown at checkout. Payments are processed by secure third-party payment providers.

6. Delivery

Delivery areas, charges and times are set out in our Shipping Policy and confirmed at checkout. If an order is not delivered within the time indicated, you may ask us to deliver within a reasonable additional period and, if we fail to do so, cancel the order and be refunded in full, in accordance with the French Consumer Code.

Risk passes to you when you, or a person you have named, take physical possession of the products.

7. Right of withdrawal and returns

Consumers have a legal right to withdraw from a distance purchase within 14 days of receiving the products, without giving a reason. SIWF extends this period to 30 days.

To withdraw, send us a clear statement of your decision before the period ends, by email to contact@siwf.eu or through our return form. You must send the products back within 14 days of telling us. You pay the cost of returning them.

We refund all payments received from you, including the standard delivery charge for the original order, within 14 days of receiving the returned products or proof that you have sent them. The refund is made with the payment method you used, unless you agree otherwise. We may reduce the refund if the products have been handled beyond what is needed to check them.

The right of withdrawal does not apply to products made to your specifications or clearly personalized, or to sealed products that cannot be returned for hygiene reasons once unsealed.

8. Legal guarantees

All products benefit from the legal guarantee of conformity (French Consumer Code, articles L217-3 and following), which applies for two years from delivery, and from the legal guarantee against hidden defects (French Civil Code, articles 1641 and following).

If a product is defective or does not match your order, contact us at contact@siwf.eu with your order number and photos. We will repair or replace the product or, where this is not possible, refund you, at no cost to you.

9. Liability

Nothing in these Terms limits the rights you have as a consumer under mandatory law. SIWF (Aqua Architect Advisory) is not liable for a failure to perform that is caused by the customer, by an unforeseeable act of a third party or by force majeure.

10. Retention of title

Products remain the property of SIWF (Aqua Architect Advisory) until they are paid for in full.

11. Intellectual property

All content on this website, including the SIWF and Say It With Flowers trademarks, logos, designs, photographs and texts, is protected by intellectual property law. It may not be reproduced or used without prior written authorization.

12. Personal data

Your personal data is processed as described in our Privacy Policy.

13. Mediation

14. Applicable law and jurisdiction

These Terms are governed by French law. If you are a consumer living in another country of the European Union, you also benefit from the mandatory protections of the law of your country of residence. Disputes are submitted to the competent courts as determined by law.
